Sports Injury Claims

This article provides information on pursuing sports injury claims.

Participating in sports activities does have a level of risk attached to it that is reasonable to expect.  Injuries will occur which are inevitable and part of the particular sport. The act of participating in any given sport itself is sufficient consent to the natural or reasonably expected level of risk of injury.

When Can a Sports Injury Claim be Considered

If a sports injury occurs that is not reasonably expected, then it may be possible to pursue a claim for compensation.  It is open to any participant in sporting activities to pursue a personal injury claim arising out of the negligence of someone else.

If a sports injury occurs due to the failure of another participant in the sports activity, inadequate supervision or training, incorrect instructions, reckless or dangerous behaviours or unsafe or poorly maintained equipment then these types of injuries may not be considered normal or reasonable.

Can Spectators Pursue Sports Injury Claims?

In addition to participants in sports activities, spectators can too suffer injuries whilst attending sporting events.  If basic safety measures are not adhered to and a spectator suffers an injury as a result, then it may be possible to pursue a personal injury claim.
